Principles on the protection of Personal Data (hereinafter 'Privacy Policy')

THIS DOCUMENT ALSO COVERS THE PROCESSING OF PERSONAL DATA AND OUR COOKIE POLICY.

 

1. Controller of personal data

The Company Photon Energy N.V., with registered seat Barbara Strozzilaan 201, Amsterdam 1083 HN, the Netherlands, registered with the Commercial registry maintained by the Dutch Chamber of Commerce (Kamer van Koophandel), corporate number: 51447126, VAT number: NL850020827B01 and Photon Energy Corporate Services CZ s.r.o., with registered seat Karolinská 661/4, Karlín, 186 00 Prague, registered in commercial register maintained by the Municipal Court in Prague, section C, number 160078, Identification number 29015367 (hereinafter ‘Controller’ or ‘We’) provides services connected with solar energy and in course of its activities administrates its website www.photonenergy.com (hereinafter ‘Website’).

2. Processing of personal data

Within the meaning of Regulation (EU) 2016/679 Of The European Parliament And Of The Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter ‘Regulation’) we process in course of our activity personal data of visitors of the Website and we process personal data for marketing purposes as well (hereinafter ‘User’ or “You”).

In the meaning of the Regulation personal data means any information relating to an identified or identifiable natural person (hereinafter „Personal Data“). Personal Data can be processed with Your consent or without it.

The following is a list of the Personal Data that can be processed only with Your explicit consent:

  • Storing of CVs

The following is a list of the Personal Data that can be processed without obtaining Your explicit consent:

  • processing is necessary for the performance of a contract to which You are a party
  • processing is necessary for compliance with a legal obligation to which we are a subject
  • processing is necessary for the purposes of the legitimate interests pursued by us (e.g. claiming at the court, insurance company), the scope of Personal Data is restricted to the Personal Data, which are necessary for the successful claim
  • processing is necessary for the performance of a task carried out in the public interest

We process the Personal Data as a controller. Personal Data may be in some cases processed by an other processor, we can provide You with their list on Your request.

3. Processing of Personal Data from Website

We process following Personal Data from the Website:

  • IP address
  • Viewed pages
  • Date and time of viewing
  • Referrer URL

With every visit to our Website, usage data is transmitted through the respective web browser and is stored in log files.

Personal Data will be stored in anonymous form for statistical purposes to improve the Website and to protect servers from abusing of third parties which is our legitimate interest according to Article 6 para 1 letter f) of the Regulation.

Further we process Personal Data to fulfil the obligations resulting from Law No. 127/2005 Coll., on Certain Electronic Communications.

We process Personal Data from Website automated, we do not use profiling. Automated processing means processing of Personal Data, where automated information systems are used exclusively, e.g. IT applications, software etc.

4. Processing of Personal Data for marketing purposes

We further process following Personal Data for marketing purposes according to § 7 paragraph 3 Law No. 480/2004 Coll., on Information Society Services:

  • Name and surname
  • E-mail
  • Phone number

Marketing includes mainly products´ offer and services´ offer of Photon Energy group. On the basis of consent we can send You the offers electronically, preferably by e-mail. You can always request to cancel sending of the offers (opt out).

Personal Data for marketing purposes are not processed automated.

5. Transfers of Personal Data to third parties

When processing the Personal Data, there shall be no unauthorized transfer of Personal Data to third countries or international organizations (with exclusions below). In case of compliance with a legal obligation, collected Personal Data are transferred solely within Photon Energy group or public, therefore state administration and self-government authorities.

We implement appropriate technical and organisational measures to avoid unauthorized or incidental access to Your Personal Data, their change, destruction or lost, unauthorized transfer or processing or any other abuse.

6. Processing time of Personal Data

Personal Data processed in connection to the Website we process for the necessary time and we archive them according to the legal deadlines imposed by the law.

If we process the Personal Data for marketing purposes, we store Your Personal Data till You request the cancellation of this processing (opt out) unless otherwise specified longer period by other legal act.

7. Rights related to processing of Personal Data

You have the right to request the following rights. You have the right to:

  • The restriction of processing of Personal Data

  • A copy of Personal Data
  • Object to the processing of Personal Data
  • Lodge a complaint with a supervisory authority and to effective judicial protection if You consider that the processing of Personal Data relating to You infringes the Regulation

You are allowed to claim the above mentioned by writing to the registered seat one of the Controllers or by e‑mail privacy@photonenergy.com. We will respond You or provide You with the information about taken measures as soon as possible after receipt of Your request.

8. Use of Cookies

We use cookies to optimize our Website. A cookie is a text file that is either temporarily stored in the computer memory (hereinafter ‘session cookie’) or stored on the hard disk (hereinafter ‘persistent cookie’). Cookies contain information about previous requests by the User on the server or information on which pages or services have been used. The User always has the option to refuse the setting of cookies. This is usually done by selecting the appropriate option in Your browser settings or additional programs. 9. Use of Google Analytics

This Website uses Google Analytics, a web analytics service provided by Google, Inc. (hereinafter ‘Google’). Google Analytics uses cookies, which are text files placed on Your computer, to help the Website analyze how users use the site. The information generated by the cookie about Your use of the Website (including Your IP address) will be transmitted to and stored by Google on servers in the United States. Within the framework of states of European Union or other member states to Agreement on the European Economic Area Google reduces, in case of IP anonymisation on this Website, Your IP address. Only in rare cases the whole IP address is transmitted to the server of Google in USA and there reduced. Google will use this information for the purpose of evaluating Your use of the Website, compiling reports on Website activity for Website operators and providing other services relating to Website activity and internet usage. Your IP address mediated by Your browser in connection with Google analytics will not be associated with other data available to Google. Google will not associate Your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on Your browser, however please note that if You do this You may not be able to use the full functionality of this Website. 10. Changes of Privacy Policy

We are allowed to change or amend this Privacy Policy, the change is effective publishing on the Website of the Controller.
